8. Property and Existing Conditions

Customers understand that construction work can create temporary dust, noise, vibration, debris, and other normal effects associated with construction.

A&Y Carpentry LLC will use reasonable care while performing work. However, we are not responsible for damage caused by pre-existing weaknesses, hidden defects, deterioration, improper prior construction, or conditions outside our reasonable control.

Customers should inform us before work begins of any known fragile, damaged, unsafe, or unusual property conditions.

9. Materials

Materials may be selected based on availability, specifications, customer selections, budget, and the requirements of the project.

Material prices and availability may change.

If a selected material becomes unavailable, discontinued, delayed, or substantially more expensive, A&Y Carpentry LLC may discuss alternative materials or pricing adjustments with the customer.

Customer-requested material substitutions or upgrades may result in additional charges.

10. Customer-Supplied Materials

If a customer supplies materials, products, fixtures, hardware, or other items, the customer is responsible for ensuring that those materials are suitable, complete, undamaged, and appropriate for the intended installation.

A&Y Carpentry LLC is not responsible for defects, incompatibility, missing components, manufacturer defects, or failures resulting from customer-supplied materials.

Additional labor required because of defective, incomplete, incorrect, or unsuitable customer-supplied materials may be charged to the customer when permitted by the applicable contract and law.

11. Scheduling and Delays

Project schedules are estimates and may be affected by circumstances beyond our reasonable control.

Delays may result from:

12. Weather

Weather-related scheduling changes do not constitute abandonment of a project.

13. Payments

Customers agree to make payments according to the payment schedule established in the applicable written contract or proposal.

15. Cancellation

Cancellation of a project by a customer may result in charges for work already performed, materials purchased or ordered, labor committed, restocking fees, delivery charges, scheduling losses, and other amounts permitted by the applicable contract and law.

Any cancellation rights provided by applicable law will remain applicable.

16. Workmanship and Warranties

Any workmanship warranty provided by A&Y Carpentry LLC will be stated in the applicable written contract or warranty document.

Manufacturer warranties for products and materials are generally provided by the manufacturer and may be subject to the manufacturer’s own terms and conditions.

Unless expressly provided in writing, A&Y Carpentry LLC does not provide warranties beyond those required by applicable law.

Warranty claims may require inspection before corrective work is performed.

A&Y Carpentry LLC may use qualified subcontractors, suppliers, delivery companies, or other service providers when necessary or appropriate to complete a project.

A&Y Carpentry LLC remains responsible for its contractual obligations while coordinating with third parties as appropriate.

20. Photos and Project Documentation

A&Y Carpentry LLC may document project conditions and completed work for business records, warranty purposes, estimating, quality control, or dispute resolution.

We will not intentionally publish identifiable customer information without appropriate permission.

21. Customer Complaints and Disputes

Customers are encouraged to contact A&Y Carpentry LLC promptly if they believe there is a problem with the work.

Customers should provide a reasonable opportunity for A&Y Carpentry LLC to inspect and, where appropriate, correct an alleged workmanship issue before hiring another contractor to perform corrective work, except where immediate action is reasonably necessary to prevent significant damage or address an emergency.

Failure to provide reasonable notice and an opportunity to inspect or correct an issue may affect the parties’ rights and remedies to the extent permitted by applicable law.

Nothing in this section limits any rights or remedies that cannot legally be waived.
